What is a "Natural Born Citizen?" Neither Barack Obama nor Ted Cruz are eligible to be the President

The idea that Ted Cruz is even being considered for the office of President of the United States of America is a shocking indictment against the intelligence of the current living electorate in America. Why? If you examine closely the above document, Ted Cruz' birth certificate, you will notice two glaring reasons.

1. He was born in Canada.
2. His father was born in Cuba.

Section 1 of Article Two of the United States Constitution sets forth the eligibility requirements for serving as president of the United States:
No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.
 Clearly Ted Cruz was not "a Citizen of the United States, at the time of the Adoption of this Constitution." And clearly he is not a "natural born citizen."

Clearly? Indeed. There has been much, much discussion over recent years concerning the "natural born citizen" clause of the US constitution. "What does it mean?" After all, Barack Obama was born on American soil, right? Doesn't that make him a "natural born citizen?"

No.

When the framers wrote the US Constitution they used certain terms, like "natural born citizen" which they harvested from other great thinkers - thinkers like Swiss philosopher, diplomat, and legal expert Emer de Vattel.

One of Vattel's most famous works was "The Law of Nations." It was from this book written by Vattel that the framers received much of their insight into what constitutes a "nation."

Swiss editor Charles W.F. Dumas sent Benjamin Franklin three original French copies of de Vattel's Le droit des gens (The Law of Nations). Franklin presented one copy to the Library Company of Philadelphia. On December 9, 1775, Franklin thanked Dumas:

"It came to us in good season, when the circumstances of a rising State make it necessary to frequently consult the Law of Nations."

Franklin also said that this book by Vattel, "has been continually in the hands of the members of our Congress now sitting"

So what did Vattel have to say about this issue of "natural born citizen?"

From his book "The Law of Nations", referred to by the framers:

The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights. The society is supposed to desire this, in consequence of what it owes to its own preservation; and it is presumed, as matter of course, that each citizen, on entering into society, reserves to his children the right of becoming members of it. The country of the fathers is therefore that of the children; and these become true citizens merely by their tacit consent. We shall soon see whether, on their coming to the years of discretion, they may renounce their right, and what they owe to the society in which they were born. I say, that, in order to be of the country, it is necessary that a person be born of a father who is a citizen; for, if he is born there of a foreigner, it will be only the place of his birth, and not his country.
Ted Cruz was born in Canada to a Cuban father. Now, I ask you, knowing what you now know about what is clearly defined by Vattel, the framers' own source for its definition, is Ted Cruz eligible to be POTUS as a "natural born citizen?" The answer is clearly "no."

If we are to believe the highly questionable account of Barack Obama's proffered birth narrative, that, by his own admission, he was born to a Kenyan father, then we must conclude that Barack Obama is not a "natural born citizen" and therefore not eligible to be the President.

And neither, especially, is Ted Cruz who's father did not become a citizen until 2005, long after Ted was born.

So unless there is a constitutional amendment on the ballot in 2014 Ted Cruz' name should not be on the ballot in 2016.

Now, what do Americans do about the ineligibility of Barack Hussein Obama?

    Answer; Vattel is not the source for the definition. In fact, he his not mentioned in the Federalist Papers at all. The source for the definition is THE COMMON LAW. In fact, the first American to use the term-----John Jay in his letter to George Washington----was an expert in THE COMMON LAW. If he were using the term to refer to Vattel or to use it any differently than in the common law, he would have said so---and never did.

    1. The framers had no need to define “natural born Citizen” in the Constitution, because by the time of the Federal Convention of 1787, a formal definition of the term consistent with the new republican principles already existed in Emer Vattel’s classic, Law of Nations.

      And we know that the Framers carefully studied and relied upon Vattel’s work.

  2. Where does it say in the Constitution that BOTH parents must be U.S citizens? Even if ONE parent is a citizen, isn't that child still a natural born citizen if born on American soil? What happens if the father is not known, or deceased?

    1. The constitution says the POTUS must be "natural born." Vattel defined "natural born" as a person born on US soil to two american citizens. The framers consulted the writings of Vattel when writing the constitution. This issue is hereby resolved.

  3. Seems to me that people are ok with bending the rules when it suits them. Everyone wants to give Ted Cruz a pass because he genuinely seems to be on our side. I like him too, but he is simply not eligible, shame though it may be.

  4. anonymous may be from "Fogbow" and doing his best to confuse the issue. John Jay also followed up his "hint" that the president be a natural born citizen by explaining that there should be no foreign influence in the commander in chief. How can anybody say that someone born in Canada to a foreign father doesn't have any foreign influence. Similar with Obama who was born as a British subject.

  5. Thank you. I've arguing this all along. It has been so painful to see these so called experts arguing NBC wrong all these years in the 'born of citizen parents on the soil' crap. That is Vattel taken out of context. He basically said: There can be no doubt that a person born of citizen parents on the soil is Natural Born. HOWEVER and that's a big HOWEVER he concluded that this citizenship followed the FATHER. Remember in his days women for all practical purposes had no standing. Also Natural Law is of the simplest denominator and of and unable to be diminished further. It's to a single final point that can be no further reduced, eg.. In Judaism the single and only determining factor to establish if you are a Jew is 'Is your mother a Jew?' Why, because you were seen coming out of her uterus and she was a Jew! It can be no doubt. In Islam it's determined that you are a Muslim how? Your father is a Muslim, then you are a Muslim! Natural Law. So therefore Soebarkah is not a natural born Citizen of the USA but of the land of his father and... he is a Muslim. Unless, his parents were Malcom X and Joanne Newman, or Stanley Ann Dunham, then he would have been A natural born Citizen of the USA. However, if he lost that Citizenship because of adoption to Soetoro and did not reclaim it and traveled on a citizen passport as an adult his NBC of the USA was lost AND CANNOT be restored.People need to clarify the Let there be no doubt argument of citizen 'Parents on the soil' and realize that was natural law for idiots the single deciding indivisable truth is the citizenship of the son follows the FATHER! I'm not anonymous I'm NaturalBoredCitizen.
