Greg Gutfeld is the outspoken host of “The Greg Gutfeld Show” on the Fox News Channel. He has made several comments implying that he does not believe Barack Hussein Obama was not born in the U.S. on the 5:00 p.m. daily show, “The Five,” which he co-hosts.

(Oct. 3, 2015) — In the opening statement of “The Greg Gutfeld Show” on the Fox News Channel, host Greg Gutfeld showed a photo of Pope Francis during his recent U.S. trip, stating (paraphrased), “If only he could be president, but he wasn’t born here, so he can’t.  Not that that matters anymore…”

On FNC’s “The Five,” which he co-hosts Monday through Friday at 5:00 p.m., Gutfeld has referred to Barack Hussein Obama as having been born outside of the country, which is generally understood to disqualify a person from presidential eligibility.

However, Sen. Ted Cruz, who declared his presidential candidacy on March 23, was born in Calgary, Alberta, Canada. Cruz claims eligibility it by stating that his mother was a U.S. citizen, which he maintains makes him a “natural born Citizen.”

At the time of Cruz’s birth, Canada awarded citizenship to anyone born in the country, regardless of the parents’ citizenship.

On one occasion during “The Five,” just after Cruz announced his candidacy, Gutfeld askedexasperatedly, “Aren’t we tired of having a president who was born outside the country?”

Article II, Section 1, clause 5 of the U.S. Constitution states that the president and commander-in-chief must be a “natural born Citizen.”  Historical commentaries, documents, congressional statements and citizenship research show that the citizenship of a person’s parents determined a child’s citizenship, not the child’s birthplace.

Some researchers and constitutional scholars go farther and maintain that “natural born Citizen” means “born in the country to two citizen parents.”  In the 1875 case of Minor v. Happersett, the U.S. Supreme Court ruled that there was “no doubt” that such individuals were “natural born Citizens” but that for those outside of that category, “there have been doubts.”

For the last eight years, discussing Obama’s origins, background, and citizenship has been taboo, with anyone suggesting that his allegiance is divided or demonstrating that his life story has been tolddifferently at different times is “racist.”

Obama claims “a father from Kenya and a mother from Kansas” on his White House biography.  In May 2012, Breitbart News revealed that Obama’s literary agent had published a 1991 promotional bookletcontaining a biography of Obama which stated that he was “born in Kenya and raised in Indonesia and Hawaii.”  The bio remained unchanged until two months after Obama declared he was running for the presidency in 2007, when it then reflected that he was allegedly “born in Hawaii.”

Others such as Will Hoover, formerly of The Honolulu Star-Advertiser, and MSNBC commentator Chris Matthews, have stated that Obama was “born in Indonesia.”

Slightly more than four years ago, the Maricopa County Cold Case Posse launched a criminal investigation into the long-form birth certificate image posted on the White House website on April 27, 2011 following pressure from now-presidential candidate Donald Trump.  The image was purported to be a scan of a certified copy of Obama’s original birth certificate demonstrating that he was born in Honolulu, HI on August 4, 1961, presumably qualifying him to be chief executive.

In the days leading up to the White House’s release, CNN and the AP published reports maintaining that the short-form birth certificate posted at Obama’s 2008 campaign website, FighttheSmears, was authentic.

On March 1, 2012, posse lead investigator Mike Zullo and Maricopa County Sheriff Joseph M. Arpaioheld a press conference to reveal that the investigators had found that the long-form birth certificate image and Obama’s Selective Service registration form are “computer-generated forgeries.”

At 10:13 p.m. EDT, Gutfeld responded to a comment from guest Alan Colmes questioning Dr. Ben Carson’s readiness for the presidency by virtue of his career as a neurosurgeon by retorting, “I guess being a community organizer qualifies you, too.”

In 1985, Obama reportedly took a job in Chicago as a community organizer working with the poor instead of a more lucrative position.  Some narratives of Obama’s life state that he worked for Business International Corporation for 1-2 years following his purported 1983 graduation from Columbia College.

In contrast to Gutfeld’s approach, FNC’s Heather Nauert and Bill O’Reilly have claimed on-air that the long-form birth certificate image is “absolutely legitimate.”  Early in 2009, O’Reilly claimed to have investigated the short-form “Certification of Live Birth” in Hawaii, where it reportedly originated.  Theimage was posted at The Daily KOS and FighttheSmears in June 2008 and later claimed by White House press secretary Robert Gibbs to have been issued by the Obama campaign.

Along with the rest of the mainstream media, Fox has refused to report on the posse’s findings and the launch of a second criminal investigation by Arpaio in late 2013.  Arpaio is now embroiled in a civil contempt trial for allegedly racially profiling Latinos during traffic stops and immigration sweeps.  In May, federal Judge G. Murray Snow demanded the work product of his criminal investigation, which is unrelated to the civil contempt charge.

On September 22, Cold Case Posse lead investigator Mike Zullo was subpoenaed to testify about his knowledge of the second criminal investigation.  The probe of Obama’s long-form birth certificate was mentioned during Arpaio’s testimony in April.
